Restoration of patent rights

Definition 

        The parties (the applicant or the patentee) due to irresistible circumstances or other legitimate reasons and delay the "Patent Law" or "Rules for the Implementation of the Patent Law", or the period designated by the State Council administrative department of patents, resulting in the loss of its rights, within 2 months from the date of removal of obstacles, (irresistible circumstances) at the latest within 2 years from the date of expiry of the period, you can apply to the State Council administrative department of patents Request for restoration of rights.

        Termination scenarios

1. Failure to pay annual fees as required;

2. The patentee renounces the patent right by written declaration; 

3. The patent right shall be terminated upon expiration of the patent right.
