Response to examination opinions
Definition
In the course of preliminary examination or substantive examination, if the examiner finds that the application documents do not comply with the Patent Law or the Rules for the Implementation of the Patent Law, the examiner will notify the applicant in the form of an "examination opinion", requesting him/her to state his/her opinion or amend the application within the specified period; without justifiable reasons If the applicant does not reply after the deadline, the application will be deemed to be withdrawn.
Types of Examination Opinions
1. Can be issued without search;
2. Patentable, but with insignificant defects;
3. Patentable, but with serious defects;
4. No novelty or inventiveness for which a patent may not be granted;
5. The problem of homogeneity.
